Terms of Agreement 

1. General Information
1.1 Company Name: Smart Speak English School.
1.2 Service Scope: Smart Speak provides online English lessons to individuals of all ages (minimum age: 3 years). Classes include one-on-one and private sessions taught by professional teachers using digital materials.
1.3 Platform & Materials: Lessons are conducted via Zoom, ClassIn, or Skype in emergencies. Students receive lesson materials as PDFs for review before class.

2. Payment Terms
2.1 Accepted Payment Methods: Credit card, PayPal, and bank transfer.
2.2 Pricing:

• Trial lessons are available at reduced rates.
• Discounts: 5% for 24 units, 10% for 36 units (1 unit = 12 lessons).

2.3 Subscription Plans:

• Subscriptions auto-renew unless canceled before the debit date.
• Students may cancel during the initial 14-day period for a full refund, provided no classes have been attended.

2.4 Refunds:

• Refunds will account for banking fees (e.g., payment processing charges).

2.5 One-Off Payments: Available for non-subscription purchases.

3. Scheduling & Attendance

3.1 Booking Classes: Students can book classes up to 24 hours before the scheduled time.

3.2 Cancellations:

• Student cancellations must be made 24 hours in advance to retain the lesson credit.
• Teacher cancellations: If a teacher cancels within 24 hours, students can keep their credit or rebook with another teacher. For last-minute cancellations, students retain their credit, with no option to reassign.

4. Class Policies

4.1 Class Duration: Classes are 25 or 50 minutes.

4.2 Technical Issues: Teachers are trained to handle technical issues. Severe disruptions on either side may result in a refunded class credit.

4.3 Account Use: Accounts are personal and non-transferable. Sharing accounts is prohibited.

5. Learning Materials

5.1 Ownership: All resources provided by Smart Speak, including PDFs and PowerPoint materials, are proprietary.

5.2 Usage Restrictions: Materials are for personal use only and may not be shared or redistributed. Unauthorized distribution will result in account termination.

6. Teacher Availability

6.1 Reassignment: If a teacher becomes unavailable, students may:

• Rebook with another teacher.
• Keep their credit for future use.

7. Disclaimers

7.1 Results: Smart Speak cannot guarantee specific outcomes or improvements. Factors such as lesson frequency, student effort, and external practice influence progress.

7.2 Liability: Smart Speak is not liable for results or disruptions caused by external factors (e.g., internet issues).

8. Governing Law & Disputes

8.1 Applicable Law: This agreement is governed by South African law.

8.2 Dispute Resolution: Disputes will be addressed amicably and reasonably within the scope of these terms.

9. Amendments

9.1 Smart Speak reserves the right to update these Terms of Agreement at any time. Changes will be communicated to students via email or the platform.
